Matsumoto v. Labrador (Idaho)
(Case No. 1:23-cv-00323-DKG)
This federal lawsuit against the State of Idaho alleges that the recently passed the ‘Abortion Travel Ban’, §18-623, violates both the First Amendment and the right to travel within and between states. The Idaho law makes it a felony, with two to five years of prison time, for any adult who helps a minor get an abortion or procure abortion pills if that help is deemed to have been provided with an intent to conceal the abortion from a parent or guardian.
The Idaho law would make this a crime even if the abortion happened in a state where the procedure is legal.
